1. Prices
- Prices in catalogues and brochures are published retail prices and are subject to
change without prior notice.
- Prices in offers are based on deliveries in Dubai . Unless otherwise specified,
validity of our offers is for one (1) month from the date of our offer. Prices are
calculated on the base of a complete order. We reserve the right to revise our offer
when ordering only parts of it.
- Prices in our order confirmations are firm within a period of six (6) months after
order confirmation as long as the down-payment has been received. Prices can be
fixed for another six (6) months by pre-payment of the whole amount when placing
the order.
- If not specifically mentioned in writing on our order confirmation, installation
of the goods is not included within the selling prices.
- For orders under AED 1000 a charge for packaging and delivery is applicable and
will be communicated accordingly.
2. Packaging
Packing material will be charged separately when products are to be shipped outside
of the UAE.
3. Delivery
Delivery of goods in Dubai & Abu Dhabi will be effected free of charge
for orders exceeding AED 1000. Costs for transportation and delivery of the goods
from Dubai to any other region within the UAE or to other countries will be charged
to the customer’s account. Resulting charges are to be paid prior to shipping of
the goods.
4. Inspection of the goods
Upon receipt of the goods, the customer has to inspect them immediately and any
damages should be recorded on the invoice. Damaged goods have to be returned to
our warehouse. A replacement item will be given or a credit note issued to the customer
if no replacement is available. Transport damages have to be addressed to the carrier
and to BMC Gulf LLC at the moment of the delivery. Other claims have to be addresses
to BMC Gulf LLC within 10 days.
5. Guarantee
Faults which are not visible immediately as well as manufacturing faults and material
faults which are not caused by wrong maintenance, have to be addressed to BMC Gulf
LLC immediately and not later than 10 days after recognizing them. Guarantees on
products may vary between the various product types. After this guarantee-period
BMC Gulf LLC will not accept any liability. Defective material will be substituted
for or we grant a price reduction for the faulty material. However, any claim does
not enable the customer to suspend the payment of the goods. Furthermore, the guarantee
excludes any responsibility arising from defects resulting from a wrong use of the
material, wrong maintenance of the material, improper use during the installation,
use of wrong cleaning agents or any type of misuse of the material.This is also
meant for little differences in colors, especially at natural stones and materials
in wood, ceramics, concrete and eggshell. BMC Gulf LLC refuses any liability for
material that has been properly delivered and has been damaged during installation
by a third party. BMC Gulf LLC will not provide guarantee coverage to any products
delivered unless the same have been fully paid.
6. Special articles
Special articles like washbasins in glass, bathroom furniture, shower cabins and
custom made models will in any case be installed by BMC Gulf LLC. BMC Gulf does
not accept any responsibility for any damages which are caused by third persons.
This refers only to products which are installed within the UAE.
Installation of purchased goods outside the territory of the UAE can be arranged
against charges that are to be agreed upon prior to the actual installation.
7. Return of goods
For returned goods, BMC reserves the right to deduct an amount equaling up to 20%
of the selling price. The return of goods has to be accepted by the supplier. Return
of material after more than 2 months from the date of delivery cannot be accepted.
The same applies for damaged or used products as well as for special articles and
custom made models. Return of goods will only be accepted in original packing material.
Goods which have been ordered from abroad cannot be returned.
8. Design and planning
Planning of a bathroom will be charged by effective costs or as a flat rate. Measurement
sketches which are necessary for obtaining special offers will be charged by effective
costs.
9. Terms of payment
50% of the order amount upon order confirmation 40% of the order amount upon delivery
10% of the order amount upon installation, if applicable. If not applicable, the
balance 10% is to be released upon delivery
10. Reservation of ownership
Delivered goods will remain property of BMC Gulf LLC until all invoices
are paid in full.
11. Right of withdrawal
Changes concerning the private circumstances of the customer like delay of payment,
insolvency, changes concerning the property, death, collection, legal action etc.
entitle the supplier to withdraw from all delivery commitments. Due payments from
the customer are payable immediately.
12. Jurisdiction of disputes
Jurisdiction for all arising disputes is Dubai – UAE.
